General Terms and Conditions - What to Do

Introduction
DMC Madeira, Lda., legal entity no. 511 227 272, is a travel and tourism agency licensed in Portugal, specialising in Destination Management and dedicated to the organisation, promotion and commercialisation of tourist experiences, always with the highest quality standards.
DMC Madeira creates, operates and provides the ‘What To Do’ project, which aims to facilitate access to local activities and tourist experiences through a digital platform that advertises and allows reservations for experiences provided by duly qualified and legally compliant suppliers.
DMC Madeira mainly provides tourist services under the terms of Decree-Law No. 17/2018, of 8 March, as provided for in Article 3, including:
- The organisation and sale of package tours and the facilitation of related travel services;
- Representing other domestic or foreign travel and tourism agencies, as well as acting as an intermediary in the sale of their services;
- Tourism promotion and advertising services.
The ‘What To Do’ project is a digital advertising and booking platform operated by DMC Madeira, which may include its own experiences and/or experiences provided by third parties. DMC Madeira acts as an intermediary between the user and suppliers, unless otherwise expressly stated.
DMC Madeira guarantees that all suppliers presented comply with the legal and safety requirements applicable to their activity, but it is not responsible for the execution of services provided directly by third parties, unless it is the service provider itself.
Purpose
1. These Terms and Conditions apply to all customers, whether individuals or legal entities, who make a booking or contract for tourist services through the ‘What To Do’ platform.
2. These Terms and Conditions regulate access to and use of the digital platforms and promotional content associated with ‘What To Do’, including booking forms, QR codes, and other related tools.
3. By accessing the content, scanning a QR code or making a booking, the user declares that they have read, understood and accepted these Terms and Conditions.
Definitions
For the purposes of these Terms and Conditions:
- “Platform” means the digital systems, websites, QR codes and advertising tools used under the “What To Do” project.
- “Supplier” means the entity that provides the tourist activity or experience advertised on the platform.
- “User” or “Customer” means any person who accesses the platform, scans a QR code, requests information or makes a booking.
- “Booking” means the act of requesting participation in a tourist experience via the platform, subject to confirmation by the supplier.
Bookings and Confirmation
1. Bookings made through “What To Do” constitute a request and are subject to confirmation of availability by the supplier.
2. The customer will receive a booking reference and will be contacted to confirm final details, pricing, and availability.
3. DMC Madeira reserves the right to refuse bookings whenever the requested service is unavailable, the information provided is insufficient, or there are safety/legal constraints.
Prices and Payments
1. Prices displayed may be indicative and subject to confirmation depending on availability, seasonality, number of participants, and specific conditions of the supplier.
2. Payment conditions (advance payment, on-site payment, cancellation fees) will be communicated at confirmation stage and may vary by supplier/activity.
3. In the event of promotions or discounts, such conditions will be clearly identified and applied according to stated rules.
Cancellations and Changes
1. Cancellation and rescheduling policies vary by experience and supplier, and will be communicated at booking confirmation.
2. The customer must comply with the cancellation deadlines to avoid penalties.
3. Suppliers may cancel or reschedule experiences due to weather conditions, safety reasons, force majeure, or operational constraints. In such cases, alternative dates or refunds will be handled according to supplier policy.
User Obligations
1. The user must provide accurate and complete information when making a booking request.
2. The user must comply with the supplier’s rules, safety instructions and participation requirements (age limits, physical condition, licenses, etc.).
3. The user is responsible for arriving on time at the meeting point and for ensuring they meet the conditions required to participate.
Liability
1. DMC Madeira acts as an intermediary for third-party suppliers and is not responsible for the execution of services provided by those suppliers, except when DMC Madeira is expressly identified as the provider.
2. DMC Madeira is not liable for damages resulting from incorrect information provided by the user, non-compliance with safety rules, or circumstances beyond its control (including force majeure).
3. Suppliers are responsible for having appropriate insurance and legal licences for their activities.
Intellectual Property
All content on the platform (texts, images, logos, design, videos) is protected by intellectual property rights and may not be copied or used without prior written authorisation.
Personal Data
Personal data is processed according to our Privacy Policy. By using the platform, the user acknowledges the data processing terms described therein.
Applicable Law and Jurisdiction
These Terms and Conditions are governed by Portuguese law. In case of dispute, the courts of Funchal shall have jurisdiction, without prejudice to mandatory consumer rights.
